This agreement made by and between “Applicant” and Pony Express – Lake City, hereinafter referred to as “Mail Service”, shall be governed by these terms to which each party agrees:
By acknowledging and completing the United States Postal Service (USPS) PS Form 1583, a copy of which will be made available to the USPS, applicant appoints Mail Service as agent for the receipt of mail for a period not to exceed that for which rent has been paid in advance. Applicant will pick up mail at least once each month or make other suitable arrangements, in advance, with Mail Service.
Mail Service does not and will not maintain a list(s) of persons authorized by applicant to collect
mail other than those individuals that have completed the required PS Form 1583.
Once Mail Service has placed Applicant’s mail in the assigned digital receptacle, the mail shall be
deemed to have been delivered and Mail Service shall not be responsible for loss, theft, or damage.
Mail Service is not engaged in the delivery of mail and cannot be responsible for the failure of
the USPS to deliver mail or to deliver it in a timely fashion or undamaged condition. Mail Service
has no control of internet/cellular connectivity and has no way to ensure deliverability of
Electronic items.
Applicant agrees to use services in accordance with Mail Service rules and in compliance with all
USPS regulations, as well as local, state and federal statutes and regulations. Failure to do so
may result in cancellation of service without notice, refund of mail forwarding.
Information provided by applicant will be kept confidential and will not knowingly be disclosed
without applicant’s prior consent, except for law enforcement or postal operation purposes, in
which case Mail Service intends to cooperate fully. Law enforcement is further clarified to
include all city, county, state or federal agencies or their representatives.
Mail will not be accepted for more than (3) persons or entity in the single mailbox without
additional administrative fees. Each adult (18 years old) or entity receiving mail in the mailbox
must complete a USPS Form 1583 and provide required identification per USPS requirements.
Each company, entity or organization receiving mail in a mailbox must be listed on the PS Forms 1583. Mailboxes are for the sole use of the registered business, organization or individual(s).
Subleasing to others is prohibited. If Applicant consistently receives substantially more mail
than allowed by the plan, Mail Service reserves the right to require applicant to upgrade monthly
service to a more suitable plan. Charges for services are based upon average daily volume and
activity. Special circumstances, e.g., high number of parcels, etc may require assessment of
additional fees or termination of the mail receiving service.
Applicant further agrees that any parcels delivered to this address for the applicant will be
delivered by common carrier only, that no motor freight, truck line type deliveries will be made
without prior arrangements and fees, that all parcels will be retrieved within 24 hours after
delivery, and that no hazardous or dangerous material will be delivered to this address. Failure
to adhere to any of these delivery stipulations may result in termination of service.
Applicant agrees to protect, indemnify and hold harmless Mail Service from and against any and all claims, demands and causes of action of any nature whatsoever relative to use of Mail Service
facilities or services. Should Mail Service commit or fail to commit any act which results in
disruption of service and applicant thereby suffers a loss, Mail Service’s liability shall be
limited to not more than the rental fees paid by applicant for service not yet received. Mail
Service shall not be liable for incidental or consequential damages.
Applicant understands that the relationship of the parties hereto is one of bailment and not
landlord and tenant. Per USPS regulations, Certified Mail must be accepted by Mail Service on
behalf of applicant. A notice will be placed in customer’s mailbox for all accountable items
(items requiring a signature) from all carriers. C.O.D. mail or parcels will be accepted by Mail
Service only with prior notification and full payment (check or money order (no cash).
Otherwise C.O.D. mail and parcels shall be refused. Registered Mail cannot be accepted by Mail
Service.
Applicant may use either the designation PMB or the (the number sign) # to designate their address. NO OTHER DESIGNATIONS ARE PERMITTED. Specifically EXCLUDED is the use of Suite, Apt., Dept., P.O. Box and all other designations. The USPS may refuse to deliver mail if incorrectly addressed.
Applicant is responsible for notifying all correspondents of the correct designation and address.

Mail Service Rental Fees are due and payable in advance and will be billed automatically on the
first of each month to the card on file. No other notice is required. Failure to pay such fees
when due may result in disruption or cancellation of services. When service is cancelled, Mail
Service is required to return the USPS 1583 form marked “CANCELLED” to the Post Office. Should applicant desire to resume mail delivery service all prior
unpaid fees are due. Mail Service does not prorate fees and does not provide refunds in the event of cancellation by applicant. Applicant understands prices are subject to change without notice
Should the account be terminated due to Non Payment and Applicant desires to continue service with Mail Service a new application and new USPS Form PS 1583 must be completed and all fees associated with a new rental must be paid in advance including all setup fees.
Applicant is responsible for notification to Mail Service, in writing, of any changes to Applicants
information. This includes current address, phone number, email address, credit card account
number or expiration date. If Applicants credit card is declined for any reason, Mail Service
shall cease to provide further services and this agreement shall be considered terminated.
Mail Service does not provide refunds in the event of cancellation by applicant or upon default and
termination.
Upon termination of services by Applicant or by Mail Service, or failure to pay rent in advance by
applicant, Mail Service shall not make applicant’s mail available without payment theretofore.
Mail Service shall also refuse delivery of any package or letters addressed to the applicant
Applicant understands that the USPS will not accept a Change of Address and will not forward mail
from a CRMA without new postage. Applicant agrees to the following: Do Not Forward, add new
postage or Store Mail without prior arrangements. I understand that mail will be destroyed.
If at termination, applicant requires mail forwarding, applicant shall continue box rental to Mail
Service with a forwarding address and place a forwarding deposit with Mail Service, funds from
which Mail Service shall debit the required fees for Postage and Forwarding Service until
forwarding is no long required.
Payment of Rental Fees and/or Forwarding Fees to Mail Service does not permit the Applicant the use of Mail Service Trade Name, dba name, telephone or facsimile numbers. Applicants use of Mail Service’s Trade Name(s), dba Names, telephone or facsimile numbers without written consent is strictly prohibited and Applicant shall be subject to prosecution.
